§1 Scope of application and contractual partners

  1. These General Terms and Conditions (GTC) apply to the use of our website https://kinderparties.ch and to all contracts concluded by our customers via the website of the provider https://kinderparties.ch (operator: Vanessa Schnabel Events, Brunnenwiesliweg 7, 8810 Horgen, Switzerland, owner: Vanessa Schnabel).
  2. There are two types of contracts that can be concluded via the website:
    1. Rental contracts: For all products called "Party Crate", "Bakeware Rental" or "Rental Crate" (hereinafter only referred to as Rental Crates), customers conclude rental contracts via the provider's website. Under these rental agreements, ownership of the rental items remains with the provider at all times and is never transferred to the customer. The rental boxes are only provided for use.
    2. Purchase contracts: Customers conclude purchase contracts for all other products that do not bear the name "rental boxes".
    3. Where contracts are referred to below, these regulations apply to both types of contract. If the treatment of the contracts differs, this is differentiated by the terms rental contract and purchase contract.
  3. A customer is any natural or legal person who places orders via https://kinderparties.ch.
  4. The contracts are concluded with the operator Vanessa Schnabel Events, Brunnenwiesliweg 7, 8810 Horgen, Switzerland.
  5. The range of goods is aimed exclusively at customers with a Swiss delivery address.

§2 Information on this website

  1. https://kinderparties.ch contains information about products and rental items. Prices, product ranges and technical specifications are subject to change without notice. All information on https://kinderparties.ch (product descriptions, illustrations, dimensions, weights, technical specifications and other information) are to be understood as approximate values only and in particular do not represent any assurance of properties or guarantees, unless explicitly stated otherwise. Vanessa Schnabel Events makes every effort to ensure that all details and information on this website are correct, complete, up-to-date and clear, but Vanessa Schnabel Events cannot provide any express or tacit guarantee in this respect.
  2. All offers on this website are subject to change and are not to be understood as a binding offer.
  3. Vanessa Schnabel Events cannot guarantee that the products listed will be available at the time of ordering. Therefore, all information on availability and delivery times is without guarantee and may change at any time and without notice.

§3 Conclusion of contract

  1. Purchase articles / store articles
    1. Offer to conclude a contract / purchase contract
      1. Articles in stock: For articles in stock, Vanessa Schnabel Events makes a binding offer to conclude a purchase contract for this article.
      2. Articles not in stock: Articles that are not in stock cannot be ordered. Therefore, Vanessa Schnabel Events does not make a binding offer to conclude a purchase contract for these items. Most items can be reordered on request.
    2. Conclusion of contract
      1. All customers can initially place the products in the shopping cart without obligation and correct their entries at any time before sending their binding order by using the correction aids provided and explained for this purpose in the order process.
      2. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the "Buy" button.
      3. Immediately after submitting your order, you will receive a confirmation email from kinderparties.ch.
  1. Rental contract
    1. The placement of the rental boxes in the online store represents a non-binding invitation to the customer to order a rental item from https://kinderparties.ch.
    2. By placing an order via this website, including the acceptance of these GTC, the customer submits a legally binding offer to conclude a contract. https://kinderparties.ch then sends an automatic "order confirmation" by email, which confirms that we have received the customer's offer. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.
    3. The contract is concluded as soon as Vanessa Schnabel Events sends a declaration of acceptance by email, in which the availability of the ordered rental boxes on the desired date is confirmed. This email shall be deemed as acceptance of the purchase offer.
    4. End of contract for rental contracts: The rental contract is agreed for a fixed period. The customer rents the rental crates for the following period: 2 days before the start of the party until 2 days after the children's party. Termination of the rental contract does not require notice of termination.

§4 Contract language, contract text storage

  1. The language available for the conclusion of the contract is German.
  2. We save the text of the contract and send you the order data and our right of withdrawal by email. You can view and download the GTC at any time at https://kinderparties.ch/policies/terms-of-service. If you have registered as a customer, you can view your past orders in our customer login.

§5 Prices

  1. The prices quoted on https://kinderparties.ch are in Swiss francs (CHF). They include VAT, plus shipping costs (see §7) and any costs for a specific payment method (see §6). All costs incurred are displayed in the shopping cart before the order is completed by clicking the "Buy" button.
  2. For our purchase items, the prices are to be understood as the purchase price. For our rental boxes, the price is the rental price.
  3. A deposit for the rental boxes is not charged.
  4. We reserve the right to make technical changes, errors or misprints; in particular, http://kinderparties.ch may make price changes at any time and without prior notice.

§6 Terms of payment

  1. We offer various payment options, which you can choose freely in the shopping cart.
  2. If fees are incurred for a payment method, the fee rate is stated in the description of the payment method and the total amount of the fees is displayed in the shopping cart. We do not currently charge any fees for payment methods, but reserve the right to introduce them.
  3. The following payment methods are generally available in our store:
    1. Payment with Twint
      After placing your order by clicking the "Buy" button, you will be redirected to the payment provider's website. To be able to pay the invoice amount with Twint, you need a Twint account. After completing the payment, you will be redirected back to our homepage.
    2. Credit card (Mastercard, Visacard, Amex)
      You enter your credit card details when you place your order. After you have been legitimized as the legal cardholder, the payment transaction will be carried out automatically and your card will be debited.
    3. PayPal, PayPal Express
      After placing the order by clicking on the "Buy" button or after clicking on the PayPal Express Checkout button, you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or register, legitimize yourself with your access data and confirm the payment instruction to us. The payment transaction will be carried out automatically by PayPal immediately afterwards. You will be redirected back to our homepage.
    4. Apple Pay
      To be able to pay the invoice amount via Apple Pay, you must be registered with the service provider Apple, have activated the Apple Pay function, legitimize yourself with your access data and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. You will receive further instructions during the ordering process.
    5. Purchase on account
      1. Purchase on account "Invoice with Klarna"
        1. As of July 20, 2021, we have outsourced our invoicing to the company Klarna.
        2. Therefore, if you choose the payment method Invoice with Klarna (Klarna - Pay now or pay later), you will be redirected to Klarna after placing your order, where you can securely complete your order after entering additional information.
        3. You will receive a separate email from Klarna containing all the necessary payment information. Please do not pay the invoice amount to kinderparties.ch.
        4. The payment term is 30 days from receipt of the invoice. After 14 days you will receive a payment reminder by email from Klarna. After the payment period of 30 days has expired, you will receive a reminder for which Klarna will charge a reminder fee of CHF 12. A reminder fee of CHF 15 will also be charged for each further reminder. Klarna will then pass the case on to a debt collection agency.

        6. If you have any questions about your Klarna invoice, you can contact the Klarna customer service at any time.
      2. Purchase on account Vanessa Schnabel Events
        1. In individual cases, we reserve the right to issue invoices (e.g. for additional costs incurred as part of the rental of party boxes). In this case, you will receive an invoice from us with an attached QR code. The following rules apply to these invoices:
        2. We ask you to pay the invoice amount within 14 days. If the invoice amount is not paid within the 14-day period, you will receive a payment reminder by email.
        3. If we still have not received payment 14 days later, you will receive a first reminder by post, which is free of charge for you.
        4. If payment is still not received, you will receive a second reminder 14 days later, for which we will charge a reminder fee of CHF 20.
        5. If no payment is made within 14 days, we will unfortunately have to initiate debt collection proceedings and, if necessary, a continuation request. We will charge you a collection fee of CHF 150 for the special expenses involved in debt collection and, if necessary, a continuation request. The collection fee is due from the date on which debt enforcement proceedings are initiated. The fees of the debt enforcement offices and for the seizures are not covered by this fee, but will be invoiced separately.
        6. The customer agrees that Vanessa Schnabel Events may at any time grant the third parties involved in checking the customer's creditworthiness and collecting the purchase price (in particular the credit agency CRIF AG, Zurich, or a company associated with it) access to his personal data arising from the business relationship, including all payment history from the order process. The customer is entitled to revoke the above consent in writing at any time.
    6. PostFinance
      After placing the order by clicking the "Buy" button, you will be redirected to the payment provider's website. To be able to pay the invoice amount with PostFinance, you need a PostFinance account. After completing the payment, you will be redirected back to our homepage.
    7. Prepayment
      If you select the prepayment payment method, we will only dispatch your goods once payment has been received. As it can take 1-2 days for your payment to be recorded in our system, the delivery time will be longer with this payment method. We will point this out when you select the payment method.
      To pay your invoice, please use our account details, which you will receive directly after your order on our homepage or in our order confirmation. On the following working day of your order, we will send you an additional email containing your invoice as a PDF. This will also contain a QR code for your payment.
      We ask you to make payment within 10 days of placing your order, as this is how long the goods are reserved for you. If no payment is received within this period, your order will be automatically canceled.
    8. Pay immediately with Klarna
      After placing your order by clicking the "Buy" button, you will be redirected to the payment provider's website. To pay the invoice amount with Sofortüberweisung, you do not need to register or create an account, but simply use your usual online banking details. The amount will be transferred directly from your bank's online banking account. After making the payment, you will be redirected back to our homepage.
  1. https://kinderparties.ch reserves the right to exclude customers from individual payment options without giving reasons or to insist on payment in advance.
  2. The products delivered to the customer remain the property of Vanessa Schnabel Events until full payment has been made.

§7 Shipping costs

  1. The shipping costs depend on the size (letter vs. parcel) and are calculated according to weight.
  2. The shipping costs are displayed individually for your order in the shopping cart and are adjusted and recalculated depending on the shipping method selected.
  3. There are no shipping costs if you choose collection.

§ 8 Delivery conditions, acceptance of goods

  1. Delivery is made exclusively in Switzerland and to Liechtenstein by Post CH AG to the billing address or other delivery address specified by you.
  2. Delivery times and delivery methods:
    1. Dispatch takes place after receipt of full payment or confirmation of payment, with the exception of payment by invoice.
    2. No partial deliveries are offered. All items in an order are shipped together, at the time of the latest available product, or if the order includes a rental box, the goods arrive together 2 days before the party date.
    3. The only exception to §8.2.b. is the combined order of at least one rental box and invitation cards. In this case, the invitations will be sent separately postage paid on the day following receipt of payment. The invitation cards will be sent by A Mail.
    4. Delivery times depend on the selected delivery method and the products included in the order.     5. Collection is possible instead of delivery. However, kinderparties.ch does not have a store, which is why collection is only possible after an order has been placed via the homepage https://kinderparties.ch. You can find detailed information at: https://kinderparties.ch/pages/abholung
    6. Transport damage: If goods are delivered with obvious transport damage, please make a complaint to the deliverer immediately and contact us without delay. This will help us to assert our claims against the carrier or the transport insurance company.
    7. Defects in the purchased items: The customer is obliged to inspect the delivered goods immediately upon receipt of delivery and to report any defects for which https://kinderparties.ch provides a warranty immediately in writing by email or letter to the address in the legal notice. If the inspection by https://kinderparties.ch reveals that the goods have no detectable defects or that they are not covered by the manufacturer's warranty, https://kinderparties.ch may charge the customer for the costs of return or disposal.
    8. Completeness of the rental boxes: The rental boxes must be checked for completeness upon receipt. Complaints must be reported immediately. Later complaints are excluded.

    §9 Return of the rental boxes

    1. The rental items must be returned by B Mail (PostPac Economy) to Vanessa Schnabel Events, Tödistrasse 48a, 8810 Horgen, Switzerland, no later than 2 working days after the children's party.
    2. The costs of the return shipment shall be borne by the hirer.
    3. In the event of late return, CHF 20 per day will be charged as compensation. The date of the proof of posting applies.
    4. Instead of returning the equipment by post, it must be returned in person no later than 5 days after the party to the following address: Vanessa Schnabel Events, Tödistrasse 48a, 8810 Horgen, is also possible.

    §10 Duty of care, damage, loss, excessive soiling of the contents of the rental boxes

    1. The rental boxes are to be used under the supervision of at least one adult. The adult must fulfill his/her duty of supervision and care. Use is at the user's own risk. Responsibility for any damage to property or personal injury is borne by the hirer and is expressly rejected by the rental company.
    2. You as the customer are not liable for damage that occurs in the course of normal wear and tear.
    3. If items are damaged, heavily soiled or lost, please inform us immediately so that we can arrange a replacement and the next children's party can also take place with a complete rental box.
    4. The return of the rental crate is always subject to reservation. The crate will be checked for completeness and condition at our premises. If items are missing, damaged or excessively soiled, the cost of repair or the replacement value of the individual items will be charged.

    §11 Passing on and duplication of rental box contents

    1. The passing on of the rental boxes to third parties, the reproduction of ideas, stock lists, instructions and data carriers is not permitted.
    2. The rental boxes are the intellectual property of Vanessa Schnabel Events, Brunnenwiesliweg 7, 8810 Horgen.

    §12 Cancellation policy

    1. Vanessa Schnabel Events voluntarily grants a 30-day right of withdrawal for purchase contracts. The current version of the right of withdrawal can always be found on the website at https://kinderparties.ch/policies/refund-policy. Vanessa Schnabel Events will also send you the currently valid revocation policy with your order confirmation.
    2. The right of withdrawal does not apply to rental contracts for rental boxes.
    3. The right of withdrawal may be adjusted from time to time. Vanessa Schnabel Events therefore asks you to read these provisions carefully each time you order goods.

    §13 Cancellation

    1. Purchase articles:
      1. All orders for purchase items can be canceled free of charge at any time up to dispatch. You can inform us of this informally by e-mail.
      2. As soon as the goods have been dispatched, you can make use of your right to cancel.
    2. Rental crates / party crates:
      1. Rental crates can be canceled free of charge up to 1 week before the party.
      2. We will then pack and ship your goods. After shipment, the party crate can no longer be canceled and 100% of the rental price is due.

    §14 Warranty

    1. Warranty for purchase contracts:
      1. Vanessa Schnabel Events endeavors to deliver goods of impeccable quality. In the case of defects reported in good time, Vanessa Schnabel Events guarantees that the item purchased by the customer is free of defects and functional for the statutory warranty period of generally two years from the date of delivery. It is at the discretion of Vanessa Schnabel Events to provide the warranty through free repair, equivalent replacement, reduction of the purchase price or refund of the purchase price. Further claims, in particular claims for damages, are excluded.
      2. The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties or defects caused by external circumstances. The warranty for consumables and wearing parts (e.g. batteries, accumulators, etc.) is also excluded.
    2. Warranty for rental contracts:
      Vanessa Schnabel Events endeavors to deliver goods of impeccable quality. As the rental items are used goods, a lack of functionality cannot be excluded. We also reserve the right to replace individual parts of the rental boxes with items of equal value at short notice if, for example, they are returned soiled or damaged by the previous hirer. We therefore exclude any warranty for rental boxes.
    3. Vanessa Schnabel Events is unable to give any assurances or guarantees that the data is up-to-date, complete and correct or that the website, its functionalities, integrated hyperlinks and other content will be available at all times or without interruption. In particular, it is neither assured nor guaranteed that the use of the website will not infringe the rights of third parties that are not owned by Vanessa Schnabel Events.

    §15 Liability

    1. Liability for any indirect damage and consequential damage, loss of profit or other personal injury, property damage and pure financial loss suffered by the customer is excluded in full.
      Liability for direct damage is limited to the amount of the service, product or license purchased by the customer. This limitation of liability does not apply to direct damages caused by gross negligence or intent.
    2. The customer is obliged to report any damage to the company immediately.
    3. Any liability for auxiliary persons is excluded in full.

    §16 Exclusion of liability / Disclaimer

    1. Content of the website
      1. The content of this website is carefully selected and kept up to date. Contributions marked with names represent the opinion of the authors, which does not necessarily correspond to the opinion of Vanessa Schnabel Events.
      2. Viewing and reading the website does not constitute a contract for a service provided by Vanessa Schnabel Events between the user and the provider. The information on the website is a courtesy of Vanessa Schnabel Events for the viewer and does not constitute a service. Therefore, Vanessa Schnabel Events does not guarantee the accuracy, completeness and timeliness of the website content.     §18 Application of law and place of jurisdiction

    1. Both the purchased items and the rental items that can be purchased via the website https://kinderparties.ch are shipped exclusively within Switzerland and Liechtenstein. Swiss law therefore applies.
    2. For Swiss consumers, the place of jurisdiction is prescribed by Art. 21 and 22 of the Swiss Jurisdiction Act:
      1. For actions brought by a customer, the court at the domicile or registered office of one of the parties shall have jurisdiction.
      2. The court at the domicile of the defendant has jurisdiction for actions brought by the supplier.
      3. If the consumer provides a Swiss delivery address and independently exports the goods for the children's party abroad, the court at the registered office of Vanessa Schnabel Events is to be chosen, not the foreign court.
    3. For complaints from business customers, the place of jurisdiction is the registered office of the provider.

    §19 Final provisions

    Should one or more provisions of these General Terms and Conditions be or become invalid, the remainder of the contract shall remain valid. The invalid provisions shall be replaced by the relevant statutory provisions.
